Demandas de derechos humanos de los mapuche en Chile y los discursos jurídicos

Abstract
This paper intend to contribute to establish certain coordinates that allow to show tensions that leads the demands of human rights of indigenous peoples, in this case the Mapuche peoples, in a neoliberal economic model that has not solved the discriminations experienced by indigenous people in their liberal sense within the Chilean democratic system, and therefore in order to fulfill their collective rights, new legal and political institutions that enable the transformation of a state that has refused to give them another site as subjects of rights it is needed.
En este texto se pretende contribuir a establecer ciertas coordenadas que permitan mostrar las tensiones que conllevan las exigencias de los derechos humanos de los pueblos originarios, en este caso de los mapuche, en un modelo económico neoliberal que, además, no ha resuelto tampoco las discriminaciones que experimentan los indígenas en su sentido liberal y social dentro del mismo sistema democrático chileno, y que, respecto del cumplimiento de sus derechos colectivos, se necesita nueva institucionalidad jurídica y política que permita transformar a un Estado que les ha negado en otro que les dé sitio como sujetos de derechos.
